Breaking it Down: What Latest Court Ruling Means for NFL, Lockout

The 8th Circuit Court of Appeals finally ruled on the injunction lifting the lockout. The result was a permanent residence, providing the lockout would last until the end of the appeal process. If a hearing June 3 to help determine whether the injunction of Judge Nelson lifted the lockout will be maintained, the court gave a strong indication that they are likely to over-turn the decision.

More shocking than the stay itself is strong language used in the Eighth Circuit Court.The particular nature of their argument would have a chilling effect on the hope that the NFL labor situation will be resolved before the start of the regular season.

What the Court rule?

The Court found two things. First, they ruled that the argument of Judge Nelson's skill she was unlikely to survive the appeal process. They argued that the Norris-LaGuardia Act prevented federal judges to intervene in labor disputes. The NFL argues that the NFLPA decertification was a "sham", and they were still a union.They filed a grievance with the National Labor Relations Board. They then claimed the NLRB has primary jurisdiction and a court can not lift the lockout.

Mr. Nelson has held that the Norris-LaGuardia Act is supposed to protect workers on strike, and does not apply. In addition, she led the NLRB has already decided similar cases in favor of work. The appellate court ruled that, regardless of whether the union exists, it is always a case "arising from a labor dispute." They chose to define "work" the word broadly (as in, employee involvement), rather than narrowly (as in: the unions on).This is a very special reading, and leaves the door open for other calls. Essentially, the Court did not accept the reasoning of each side (the owners: "travesty" of the defense, players: Norris-LaGuardia does not apply because we are not a union) instead that they created their own novel way of applying Norris-LaGuardia without contesting revocation of accreditation.

Second, the court ruled that Judge Nelson did not consider strongly enough "irreparable harm" in the NFL if the lockout is lifted.This decision has been less problematic for the players because they have admitted there is a balance of convenience (whatever happens, one side is injured). As a result, the balance may change over time to the players. This is not an objection that is insurmountable.

At no time did they say or imply that the lockout is legal. They only questioned the ability of the court to lift it.
